ELVRU ACCEPTABLE USE POLICY (AUP)
This Acceptable Use Policy (“Policy”) governs Client’s use of the Elvru Operational Infrastructure and related services.
This Policy is incorporated by reference into the Master Services Agreement (“MSA”).

1. Purpose
Elvru Technologies Inc. (“Elvru”) provides managed operational infrastructure including CRM systems, messaging enablement, and automation tools.
This Policy exists to protect platform integrity, messaging reputation, regulatory compliance, and all clients utilizing Elvru’s infrastructure.

2. General Acceptable Use
Client agrees to use the Platform lawfully, ethically, and in accordance with all applicable laws and regulations.
Client may not use the Platform in any way that could damage, disable, overburden, or impair infrastructure or interfere with other users.

3. Prohibited Activities
The following activities are strictly prohibited:
• Use of purchased, scraped, rented, or third-party contact lists
• Sending messages without proper opt-in consent
• Phishing, fraudulent, deceptive, or misleading communications
• Distribution of malware or malicious code
• Harassment, threats, or abusive communications
• Promotion of illegal goods or services
• Circumventing unsubscribe or opt-out mechanisms
• Attempting to reverse engineer or misuse the Platform

4. Messaging & Compliance Obligations
Client is solely responsible for ensuring:
• All contacts have provided lawful consent
• Opt-out requests are honored promptly
• Required disclosures are included in communications
• Compliance with CASL, privacy laws, and applicable messaging regulations
Elvru does not independently verify consent records and acts solely at Client’s direction.

5. High-Risk Industries
Certain industries may present elevated compliance or reputational risk, including but not limited to:
• Financial services
• Cryptocurrency-related services
• Healthcare marketing
• Political campaigns
• Gambling
• Adult content
Clients operating in high-risk industries must obtain written approval from Elvru prior to activation of messaging services.
Elvru reserves the right to decline or discontinue service based on risk assessment.

6. Deliverability & Infrastructure Protection
Elvru does not guarantee message deliverability.
If complaint rates, carrier flags, or regulatory concerns arise, Elvru may immediately suspend messaging capabilities to protect infrastructure integrity.
No refunds shall be provided during suspension resulting from Policy violations.

7. Monitoring & Enforcement
Elvru reserves the right to monitor usage patterns to ensure compliance.
Client agrees to cooperate with reasonable investigations related to messaging activity or regulatory inquiries.
Repeated or material violations may result in immediate termination of services.

8. Amendments
Elvru may update this Policy as necessary to reflect regulatory changes or infrastructure protection requirements. Continued use of the Platform constitutes acceptance of the updated Policy.

Formal service terms are provided in the Master Services Agreement and Order Form during onboarding.
